Terms of Use

1. Acceptance

These Terms of Use (the "Terms") are a binding agreement between you and Temp Inc.("we", "us", "our") governing your access to and use of the WSIB Workflow service, including the dashboard, public upload pages, APIs, email notifications and any related sites (the "Service"). By creating an account, accepting an invitation, uploading a document via an upload link or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy.

2. Eligibility and accounts

  • You must be at least 18 years old and have the authority to bind the organization you represent.
  • You are responsible for the security of your credentials, including any MFA factor, and for all activity under your account.
  • You must keep account information accurate and notify us promptly of unauthorized access at info@temp.ca.

3. Plans, fees and trials

Paid plans are billed in advance on a monthly or annual cycle, per the order form or in-app checkout. Failure to pay may result in feature restrictions and ultimately suspension under the published payment-gating policy. Taxes are your responsibility unless we are required to collect them.

4. Customer content and licence

You retain ownership of all data you submit, upload or transmit through the Service (the "Customer Content"), including contractor records, projects, documents and notes. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Customer Content solely to provide and improve the Service and to support your account.

You represent and warrant that:

  • you have all rights necessary to submit the Customer Content;
  • the Customer Content does not infringe a third-party right or violate applicable law, including privacy law; and
  • you have lawful basis to upload third-party documents (e.g. subcontractor WSIB / COI certificates) and to instruct us to process them.

5. Acceptable use

You must not, and must not allow others to:

  • access the Service to build a competing product;
  • attempt to gain unauthorized access to other tenants, audit events, upload tokens or any part of the underlying infrastructure;
  • upload malware or content that is unlawful, defamatory or that exposes us to liability;
  • scrape, decompile or reverse-engineer the Service except as permitted by law;
  • misuse upload links to send unsolicited communications to subcontractors;
  • circumvent rate limits, tenant boundaries, role checks or other security mechanisms.

6. WSIB and COI readiness — informational only

The traffic-light readiness logic in the Service is a workflow aid, not legal, regulatory or insurance advice. You remain solely responsible for compliance with the Workplace Safety and Insurance Act (Ontario), the Occupational Health and Safety Act, your insurance obligations and any contractual requirements with your clients or subcontractors. The Service does not replace the WSIB Clearance Certificate API.

7. Public upload links

When you create a document request, the Service issues a bearer upload link (/upload/{token}) and emails it to the subcontractor address you supplied. The link is a sensitive credential. We are not liable for harm caused by misdirected, intercepted or forwarded upload links once they leave the Service.

8. Third-party services

The Service is delivered on top of providers including Supabase, Railway, PostHog, Google Analytics, Google Ads and Mistral AI (optional OCR). Their availability, terms and processing locations are not under our control. The full list is maintained in our Privacy Policy.

9. Suspension and termination

We may suspend or terminate accounts that breach these Terms, that present a security or legal risk, or that have not paid amounts due. You may terminate at any time by deleting your account or by emailing info@temp.ca. On termination we will return or delete Customer Content per the retention schedule in our Privacy Policy.

10. Warranties and disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error- free, secure or uninterrupted, or that any data or readiness assessment will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period and (b) CAD $100. We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or business opportunity.

12. Indemnity

You will defend, indemnify and hold us harmless from any claim arising out of (i) your Customer Content, (ii) your use of the Service in breach of these Terms or applicable law, or (iii) your dispute with a contractor or third party that received an upload link from your account.

13. Governing law and venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute that is not subject to mandatory arbitration in your home jurisdiction.

14. Changes

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 30 days before they take effect. Continued use after that date constitutes acceptance.
